Smith Sentenced to Thirty Days Posted on February 27, 2013
Yesterday in Circuit Court the driver in a fatal crash that occurred in 2011, pleaded guilty to vehicular homicide by recklessness.
Circuit Judge Robert L. Holloway accepted the plea from Julian Brandt Smith, 22, of Pulaski, and sentenced him to 10 years in prison, which was suspended to 30 days. Smith was ordered to pay court costs and his drivers license was revoked for three years.
On December 25, 2011, just after 11:30 p.m., Smith was driving a 2008 Pontiac G8 eastbound on Vales Mill Road when he failed to maintain control of the vehicle, possibly due to speed, according to a Tennessee Highway Patrol report. One rear seat passenger, Cody Shayne Duncan, 21, was ejected from the vehicle and pronounced dead at the scene by Giles EMS paramedics. Smith and two other occupants of the car were also injured in the accident.
Smith will serve his 30-day sentence in the Giles County Jail.
