Local Businesses Receive Fines & Penalities

A disciplinary actions report is issued each month by the State of Tennessee Commerce and Insurance's Division of Regulatory Boards. Each board and commission is empowered by statute to take disciplinary action, including the revocation of licenses and assignment of civil penalties, against license holders found to have violated laws governing their professions. The following are local businesses that have violated rules and been disciplined or fined or both.
Baxter Brothers Funeral Home in Columbia, the Violation, An employee sold preneed funeral contracts without first registering with the Commissioner as a preneed sales agent, failed to keep and maintain accurate accounts, books, and records of all preneed funeral contract and prearrangement insurance policy transactions, failed to submit an application to an insurance company within the specified time and failed to file annual reports, they received a $500 Civil Penalty.
J. B. Mayberry & Sons Funeral Home in Lewisburg, the Violation, the Funeral home owner unlawfully listed as the owner and beneficiary of multiple insurance policies, failed to provide sufficient documentation to verify payments received for prearranged funeral contracts and failed to file correctly completed annual reports, they received a $250 Civil Penalty.
Pettus-Turnbo Funeral Home, of Lawrenceburg had two violations, they Provided discounts on numerous preneed funeral contracts, failed to maintain accurate accounts, books and records of all preneed funeral contract and prearrangement insurance policy transactions and failed to file a correctly completed annual report, for that they received a $1,300 Civil Penalty. And, Incorrectly charged for “bathing and handling of the deceased” in addition to having already charged for embalming and failed to comply with multiple aspects of the Funeral Rule, for that they received a $1,000 Civil Penalty.
Triple Seven Auto, of Pulaski was operating without a Business License and received a $250 Civil Penalty, and, Monee’s Design, of Columbia, was charged with a change of location of the shop without proper documentation and received a $250 Civil Penalty.
