State AG Says Cemeteries Are Public Places

The office of Tennessee Attorney General has issued an opinion on whether or not cemeteries are to be considered as “places of public gathering.” The opinion issued this week says that cemeteries are indeed a place of public gathering.

In response to a Lawrence County citizens request, the Office of the Attorney General pointed out that the issue had been settled under a previous opinion. That opinion, officials report, dictates that, “A public cemetery constitutes a public gathering place within the meaning of Tennessee Codes Annotated and the two thousand foot rule regarding the right to forbid beer sales therefore applies.”

Lawrence County Commissioner Chris Jackson submitted the request for clarification in connection with the recent revocation of beer sales licenses, ordered by the county’s Beer Board.
The entire commission, acting as the beer board, voted in late August to revoke beer sales licenses that had been issued in conflict to county statutes to New Prospect Market and Dunn’s Bait and Tackle.
State statutes require that beer sales permits not be issued to any business that is within 2,000 feet of a school, church, or other place of public gathering.
